Filing A Claim In The IRS Whistleblower Program

Tax whistleblowers constantly ask us,

How can I report tax fraud?
How does the IRS Whistleblower Program work?
What is my involvement?
Can I remain anonymous?
Is IRS whistleblower protection available?
Does IRS whistleblowing make sense in my case?

In summary, there are two ways to be an IRS whistleblower, submit information and request a reward (Form 211, Application for Award for Original Information), or submit information only (Form 3949-A, Information Referral).  Both of these options require completing the one page form and sending it in to the IRS.  If you called or visited your local IRS office you would be requested to complete one of these forms.  In both cases it is important that you provide as much specific information as possible, and to the extent you can provide documentation, you do so.  If you do not want a reward click here.

IRS REWARD. The first option requires the IRS to pay you a whistleblower award of 15% to 30% of the amount collected based upon the information you provided. However the tax, penalties and interest must be over Two Million Dollars ($2,000,000 US) to qualify for this large IRS reward. If the tax, penalty and interest is less than $2,000.000 the reward will be limited to a maximum of 15% and will be at the discretion of the IRS. To claim a reward in either circumstance you can submit a Form 211 (Application for Award for Original Information) to the IRS in which you provide “specific and credible” information that will help them detect an underpayment of tax. If in fact they collect tax, penalty and interest based upon the information provided by you then you will be eligible for an IRS Whistleblower Award. There is no cap on the amount of money that the IRS can award.

It is wise to familiarize yourself with how to report tax fraud before proceeding.  Claiming an
award cannot be done anonymously, but a Tax Whistleblower attorney can protect your identity throughout this process.  Our seasoned whistleblower lawyers will explain the steps we take to ensure maximum IRS Whistleblower protection
.  That includes multiple levels of IT security our office maintains to protect your identity and data.

A well put together claim may provide you with an IRS reward whether you report tax fraud, tax evasion, estate tax evasion, gift tax evasion, corporate tax fraud, unrecognized tax benefits, abusive tax shelters, Panama Papers-style offshore tax evasion, tax shelter promoters, tax exempt bonds fraud, tax return preparer fraud, cryptocurrency tax evasion, Bitcoin tax evasion, tribal sector tax fraud, uncertain tax positions, or even math errors. The IRS Whistleblower Program applies to any underpayment of tax for which you provide information.  Our extensive knowledge of IRS procedure, tax law and accounting enables us to package and present your valuable information in the best format for utilization by the IRS.

With respect to uncertain tax positions, we all know the tax laws are complicated and subject to interpretation.  Often the tax laws are interpreted by taxpayers and tax planners differently than interpreted by the Internal Revenue Service. Therefore, although a taxpayer may take a position on their tax return that falls within this “grey” area, should the IRS challenge the taxpayer’s interpretation that too would qualify for a reward under the IRS Tax Whistleblower Program, IRC 7623.

There are many factors to consider in each situation when deciding whether IRS whistleblowing is the right thing to do. Reporting tax evasion anonymously, IRS whistleblower confidentiality, security, availability of evidence, and the type and size of the tax issue are just a few of those factors. If you are a professional in the tax, accounting or legal field there are several more unique factors to consider which will be critical to the potential success of your whistleblower claim.

The Tax Whistleblower Law Firm will carefully analyze your circumstance and the legal and accounting aspects of your claim.  We have a certified public accountant (CPA) on staff. Your IRS Form 211 whistleblower package will be prepared by both a former IRS attorney and CPA.  Our deep tax background enables us to work with the IRS and respond to their legal and tax accounting inquiries throughout the process.  Our experienced IRS whistleblower lawyers and CPA remain available to answer your important questions.

IRS whistleblower claims can be complicated.  Therefore, it is wise to work closely with a qualified tax lawyer who can help the IRS investigate the underpayment of tax, and gauge whether the amount of a whistleblower award is appropriate under the law.  If you have knowledge of tax evasion, tax fraud, underpayment of tax, or would like to know if the information you possess qualifies under the IRS Whistleblower Program, call us at 855-211-7623.  Your confidential consultation is free.  We are responsive to our clients and you can be assured of our dedication to your claim as we exclusively represent Tax Whistleblowers like you.
